QUICK SUMMARY
Content on this website is for reference only. It is not legal advice for your specific situation.
A lawyer–client relationship is formed only when both parties sign a legal services contract.
Before making a decision, talk to a lawyer about your own situation.
Website content belongs to FC Legal; any quotation must clearly cite the source.
Article 1. Acceptance of these Terms
The website spclegal.vn is owned and operated by FC Legal Law Company Limited (“FC Legal”, “we”, “us”).
By accessing or using the website, or by submitting information through it, you confirm that you have read, understood and agree to these Terms of Use and the Personal Data Privacy Policy. If you do not agree, please stop using the website.
Article 2. Nature of the content: not legal advice
Articles, case analyses, checklists, forms, self-assessment tools and all other content on the website (the “Content”) are intended only to provide general information for reference.
The Content is not legal advice and does not replace direct discussion with a lawyer about your specific files, documents and circumstances.
Case analyses are based on published judgments and documents; the comments in them are FC Legal’s professional views at the time of writing, not the views of any state authority or court. The outcome of a case already decided does not guarantee a similar outcome in any other case.
The law changes often. The Content is updated in line with the regulations in force at the time of publication or of the update date shown on each article; FC Legal does not undertake that the Content is always complete, accurate or up to date at the time you read it.
Forms, contract templates and checklists downloaded from the website are general reference templates; you need to adapt them to your situation and should have a lawyer review them before use.
Article 3. Lawyer–client relationship
Reading the Content, sending questions through a form, email, the hotline or Zalo, using the “Khám sức khỏe pháp lý” (Legal Health Check) tool, or holding preliminary discussions does not create a lawyer–client relationship between you and FC Legal.
A lawyer–client relationship is formed only when FC Legal has checked for conflicts of interest and confirmed that it accepts the matter, and both parties have signed a legal services contract (or an equivalent written confirmation). The scope, fees and responsibilities of each party are as set out in that contract.
Before a lawyer–client relationship is formed, FC Legal has no obligation to monitor any limitation period, procedural time limit or other legal deadline that applies to you. If your matter has an urgent deadline, you must monitor it yourself and state it clearly when you contact us.
Information you send is nevertheless kept confidential under the Personal Data Privacy Policy and the rules on lawyers’ professional confidentiality.
Article 4. Limitation of liability
To the maximum extent permitted by law:
FC Legal is not liable for any direct or indirect loss arising from your use or misunderstanding of the Content, or from your reliance on it to make decisions without specific advice from a lawyer.
FC Legal does not guarantee that the website will operate continuously, without errors or free of malicious code, and is not liable for interruptions caused by maintenance, technical faults, cyberattacks, failures of service providers or force majeure events.
FC Legal is not liable for the content, products or services of linked third-party websites (Article 7).
FC Legal is not liable for accounts, social media pages, websites or individuals impersonating FC Legal. FC Legal never asks for money to be transferred to a personal account; fees are paid only by bank transfer to the company account stated in the contract or quotation, or in cash at FC Legal’s office against an official receipt or invoice.
This Article does not exclude FC Legal’s liability in cases where the law does not permit such exclusion, and does not replace the liability provisions of a signed legal services contract.
Article 5. Intellectual property rights
The content, layout, images, infographics, forms, the names and logos “FC Legal” and “SPC”, and other signs on the website are owned by FC Legal or lawfully used by it, and are protected under the Law on Intellectual Property.
You may: read, print and save one copy for personal or internal business purposes; and make reasonable quotations, citing the source “FC Legal – spclegal.vn” with a link to the original article.
Without FC Legal’s written consent, you may not: copy all or most of an article; modify, republish or sell it, or use it for commercial purposes; remove source information; or use automated tools to collect content in bulk.
Third-party trademarks and business names that appear on the website (for example in case analyses) belong to their respective owners, are mentioned only for description and commentary, and do not indicate any affiliation or endorsement.
Article 6. Prohibited conduct
When using the website, you must not:
Provide false information, impersonate another person, or send other people’s information without a lawful basis.
Send content that breaks the law or harms the honour, dignity or reputation of any organisation or individual; or send spam or advertising.
Attack the website, scan it for vulnerabilities, spread malicious code, interfere with its systems without authorisation, or disrupt its operation.
Use the website for unlawful purposes or in breach of these Terms.
FC Legal may refuse to respond, block access, preserve evidence and notify the competent authorities of any violation.
Article 7. Links to third-party websites
The website may contain links to government portals, legal document databases, social networks or other websites for ease of reference. FC Legal does not control and is not responsible for the content, privacy policies or operation of these websites. A link does not mean that FC Legal endorses or vouches for the third party.
Article 8. Contact forms, booking and self-assessment tools
Information sent through forms is processed under the Personal Data Privacy Policy. Please include only the information a lawyer needs to contact you; do not send confidential documents or sensitive data through the forms.
FC Legal confirms booking requests within 24 hours, as set out in the Service, Booking and Payment Policy. Other expected response times are stated for reference only and are not a service commitment.
Results of self-assessment tools (such as the Legal Health Check and checklists) are indicative only, based on your answers, and are not a legal conclusion or a due diligence report.
Quotations, fee schedules and service packages published on the website are for reference; the binding terms are those in the quotation or contract sent separately to each client.
Article 9. Electronic transactions
Information and confirmations exchanged through the website, email or messages have the legal status of data messages under the Law on Electronic Transactions. Legal services contracts are entered into in paper form or as electronic documents bearing the valid signatures of both parties.
Article 10. Changes to the Content and these Terms
FC Legal may amend, update, suspend or remove any Content on the website.
These Terms may be updated; a new version takes effect from the date it is posted and states its version number and effective date at the top of the page. If you continue to use the website after that date, you are deemed to accept the new version.
Article 11. Governing law and dispute resolution
These Terms are governed by the laws of Vietnam.
Disputes shall first be resolved by negotiation within 30 days from the date one party sends a notice. If negotiation fails, the dispute shall be resolved by the competent People’s Court in Hanoi, unless mandatory provisions of law provide otherwise.
Disputes arising from a legal services contract are resolved under the terms of that contract.
If any provision is held invalid, the remaining provisions remain in effect.
